Child Protection

At SKD Law, I represent parents and children involved in the child protection system.

Child protection laws set out the responsibilities of individuals, institutions, and agencies to safeguard children and provide mechanisms for intervention and support when a child’s welfare is at risk. These laws play a crucial role in ensuring the safety, well-being, and healthy development of children—some of the most vulnerable members of our communities.

  • Clarify the rights and responsibilities of parents and caregivers.
  • Detail the role and responsibilities of child and family services.
  • Describe the procedures for investigation, intervention, and support services.
  • Specify who is required by law to report suspected child abuse or neglect.
  • Balance parental rights with the need to protect children.
  • Outline the process for reporting and the protections offered to reporters.
  • Define circumstances under which parental rights may be limited or terminated.

One of the most memorable milestones in my child protection practice was successfully arguing a Canadian Charter of Rights and Freedoms case, where the Court found that Child and Family Services breached the father's section 7 and 8 Charter rights: H.L.H. (Re), 2021 NWTTC 21

In addition to individual representation, I also work extensively with Indigenous governments on child welfare matters and other legal issues. For more on that, please see my dedicated Indigenous Governments page.

I’m committed to advocating for Indigenous perspectives and ensuring families’ voices are heard and respected throughout the legal process.
